1.Publisher and contact

PURE SERENITY, a simplified joint-stock company (société par actions simplifiée) with a share capital of 1,500 euros, whose registered office is located at 58 avenue de la Grande Armée, 75017 Paris, France, registered with the Paris Trade and Companies Register (RCS Paris) under number 943 179 705, SIRET 943 179 705 00026.

Website: https://pureserenity.health (the “Site”).

2.Purpose and scope

These general terms of use (the “Terms”) govern the consultation of the Site, requests for information, the presentation of offers, appointment requests and access to payment links. “User” means any person who consults or uses the Site. The subscription process is intended for persons who have reached the age of majority.

The Terms are accessible and may be downloaded at any time. Where a service requires contractual acceptance, the Terms are provided before that service is activated and their acceptance is obtained by means of an express action. Browsing alone constitutes neither the subscription of a membership, nor a paid order, nor consent to the processing of sensitive data.

PURE SERENITY’s paid services are governed by a membership agreement, conditions of service and, where necessary, a quotation, provided before any commitment. These documents specify the content of the offer, its price, its duration and the arrangements for its performance. These Terms do not, on their own, constitute the conditions of sale of those services.

3.Role of PURE SERENITY

PURE SERENITY provides concierge services and administrative and logistical coordination services that make it possible to organise a healthcare pathway and to facilitate exchanges with healthcare professionals and healthcare establishments. Preventive, diagnostic, prescribing and care procedures are performed by the competent professionals, under their own responsibility and with respect for their independence.

The content of the Site is intended for general information purposes. It does not constitute a consultation, a diagnosis or a personalised prescription. Arranging contact with a professional (mise en relation) carries no guarantee of any medical outcome and does not restrict the free choice of healthcare professional or healthcare establishment.

Medical emergency. The Site and its messages are not an emergency service. In France, call 15 or 112; abroad, contact the local emergency services. A request sent to PURE SERENITY must never delay calling the emergency services.

4.Contact and appointment requests

The User provides accurate and up-to-date information, limited to what is useful for handling their request. Fields marked as mandatory are required in order to respond to it. The ordinary contact channels must not be used to send test results, prescriptions, medical history or other medical documents.

Sending a request for contact, for a presentation of the offers or for an appointment constitutes neither confirmation of availability nor acceptance of a membership. An automatic acknowledgement of receipt merely confirms that the request has been received. The appointment is confirmed separately, stating the identity of the person conducting it, the date, the place or channel used and any pricing conditions.

The User promptly reports any request for modification or cancellation. Any cancellation fees for a service are enforceable against the User only if they were clearly communicated and accepted before booking, subject to the consumer’s mandatory rights. No fees are payable merely by reason of making contact.

5.Membership, programmes and paid services

The Site presents the Access, Pure and Serenity offers. Their content, the beneficiaries covered, the duration, the geographical limits and the exclusions are specified in the contractual documents provided before subscription. The applicable prices, inclusive of all taxes, or the method for calculating them where the price cannot reasonably be determined in advance, are communicated before any commitment. Care, hospitalisation and third-party services not expressly included are invoiced separately.

Admission to a programme is subject to PURE SERENITY’s review of the application. Before any payment, the conditions of such admission, the treatment of sums paid in the event of refusal and the arrangements for renewal, cancellation, termination and refund are communicated to the client. Payment does not, in itself, constitute confirmation of admission. Online payments are made on the hosted pages of Stripe Payment Links; PURE SERENITY neither collects nor stores full bank card details. No additional charge may be invoiced without prior information and the client’s express agreement.

Where a concierge contract is concluded at a distance with a consumer, the consumer benefits from the statutory fourteen-day right of withdrawal (droit de rétractation), subject to the exceptions provided for by law. The procedure for exercising it, the withdrawal form and the effects of a request for performance to begin before the withdrawal period expires are provided before the contract is concluded. A commercial cancellation option does not replace the statutory right of withdrawal.

Contracts for care concluded with healthcare professionals are subject to their own legal regime. Classification as a medical service does not automatically extend to PURE SERENITY’s concierge services. The professional’s own conditions and the identity of the invoicing party are indicated before the patient makes any commitment.

6.Beneficiaries and representation

Where a person requests a service on behalf of a loved one or in a professional context, they specify the capacity in which they are acting and communicate only the information they are authorised to transmit. The beneficiaries of family or professional programmes are defined in the contract. Funding a service does not give any automatic access to the beneficiary’s personal or medical information.

7.Transmission of information

The Site’s forms are used for general enquiries and for describing coordination needs. They do not allow medical records to be submitted. Do not send through them any diagnosis, test result, prescription or medical history. If such information is necessary for a subsequent service, it is transmitted through a separate system, after information has been provided on the recipients and the conditions of processing.

8.Fair use and security

The User refrains from any impersonation, unlawful communication, attempt to access third-party data, introduction of malicious software, disruption of the Site or unauthorised extraction of its content. The User respects the rights of others and does not use the Site for unsolicited commercial prospecting.

PURE SERENITY may restrict access where a security threat or a use contrary to these Terms justifies it. The measure must be necessary and proportionate. Except in an emergency or where prohibited by law, the User is informed of the reason for it and may submit observations or rectify their situation.

A restriction of access to the Site does not automatically entail the termination of a service contract and removes neither the rights relating to data nor the possibility of contacting PURE SERENITY.

9.Availability and liability

PURE SERENITY implements the means appropriate to its obligations to ensure the operation and security of the Site. Interruptions may be necessary for maintenance or may result from an incident. The User is informed of scheduled interruptions where possible.

PURE SERENITY remains responsible for its own obligations, in particular those relating to coordination, security and data protection. Liability for medical decisions and acts lies with the professionals who perform them, without releasing PURE SERENITY from liability for its own faults.

No provision excludes the statutory guarantees, the right to compensation or any liability that cannot lawfully be limited. Force majeure is assessed in accordance with the conditions laid down in article 1218 of the French Civil Code.

10.Intellectual property

The protected elements of the Site, in particular texts, photographs, graphics, trade marks and software, belong to PURE SERENITY or to their respective owners. The User has the right to consult the Site and to download the documents expressly offered for that purpose. Any other use requires the necessary authorisation, subject to statutory exceptions. The User’s rights in their own documents remain unaffected.

11.External services and links

The Site uses, in particular, Calendly for booking appointments and Stripe Payment Links for payments. The User is informed when accessing an external service and may consult the terms and privacy policy of that service.

This distinction does not limit PURE SERENITY’s obligations in respect of the services it has undertaken to organise, nor its liability for the choice or use of the service providers it engages to perform its own obligations.

12.Personal data and cookies

The Privacy Policy sets out the data processing operations, their purposes, the recipients, the retention periods and the procedures for exercising rights. It is separate from the Terms. Accessing it does not entail giving blanket consent to all processing.

Required consents, in particular for certain trackers or certain processing of sensitive data, are obtained separately and specifically. They do not result from acceptance of these Terms. Choices relating to trackers are managed in accordance with the procedures described in the Privacy Policy.

13.Changes to the Terms

A substantial change to the services or to contractual obligations is the subject of appropriate information. Where a new acceptance is required, it is obtained before the change concerned applies.

Changes do not apply retroactively to requests already made or commitments already entered into. Membership or service contracts continue to be governed by their own provisions and by the applicable statutory provisions.

14.Complaints and mediation

Any complaint concerning the Site or PURE SERENITY’s services may be sent by email to info@pureserenity.health or by post to PURE SERENITY, Service clients, 58 avenue de la Grande Armée, 75017 Paris, France.

After first submitting a written complaint to PURE SERENITY that has not been satisfactorily resolved, the consumer may refer the matter, free of charge, to the consumer mediation body Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), with which PURE SERENITY is affiliated.
Address: 49 rue de Ponthieu, 75008 Paris, France.
Online referral: https://www.cm2c.net/declarer-un-litige.php.
Email: declarer-un-litige@cm2c.net.
Telephone: 01 89 47 00 14.
The request must be submitted within one year of the written complaint to the professional. It must not be manifestly unfounded or abusive; the dispute must fall within the mediator’s competence and must not already have been examined, or be under examination, by another mediator or a court.

Recourse to mediation is optional. The consumer remains free to bring the matter before the competent court and to accept or refuse the proposed solution. The costs of any adviser or expert assessment requested by a party remain payable by that party in accordance with the applicable rules. Disputes relating to care procedures performed by healthcare professionals are subject to the remedies specific to those procedures.

15.Governing law and jurisdiction

The Terms are governed by French law. This choice does not deprive the consumer of the mandatory protections they enjoy, in particular those of their country of habitual residence where the rules of private international law so provide.

The competent courts are determined by the applicable statutory rules. The invalidity of a provision does not affect those other clauses that can remain in force without it.
